These general terms and conditions of sale govern sales made on the website https://maisonbagages.com, operated under the trade name Maison Bagages by IML GROUP, a French simplified joint-stock company (société par actions simplifiée) with share capital of €300,120.00, registered with the Paris Trade and Companies Register under number 851 967 034, with its registered office at 50 rue Raynouard, 75016 Paris, France (EU VAT number: FR02851967034). The prices of our products are given in euros inclusive of all taxes (VAT and other taxes applicable on the day of the order), unless otherwise stated, and exclusive of handling and shipping costs. When ordering for delivery to a country other than mainland France, you are the importer of the product(s) concerned. Customs duties or other local taxes, import duties or state taxes may be payable. These duties and sums are outside the remit of IML GROUP. They are payable by you and are entirely your responsibility, both in terms of declarations and of payments to the competent authorities and bodies in your country. We advise you to check these matters with your local authorities. All orders, whatever their origin, are payable in euros. IML GROUP reserves the right to change its prices at any time, but the product will be invoiced on the basis of the price in force at the time the order is confirmed, subject to availability. Products remain the property of IML GROUP until the price has been paid in full. Please note: as soon as you take physical possession of the products ordered, the risk of loss of or damage to the products passes to you.
You can place an order: online, at https://maisonbagages.com. The contractual information is presented in French and will be confirmed at the latest when your order is confirmed. IML GROUP reserves the right not to record a payment and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem or a difficulty concerning the order received.
Any order placed on the website https://maisonbagages.com implies acceptance of these general terms and conditions. Any order confirmation entails your full and unreserved acceptance of these general terms and conditions of sale, without exception or reservation. All the data provided and the recorded confirmation will constitute proof of the transaction. You declare that you are fully aware of this. Order confirmation constitutes signature and acceptance of the transactions carried out. A summary of your order details and of these general terms and conditions will be sent to you in PDF format via the e-mail address used for your order confirmation.
Confirming your order means that you are obliged to pay the price shown. The price is due as soon as the order is confirmed. Payment for your purchases is made by bank card (Visa, Mastercard, American Express), Apple Pay, Google Pay, Shop Pay and PayPal, via the secure Shopify Payments platform. Your banking details are encrypted and do not pass through the servers of IML GROUP. No split or deferred payment is offered.
In accordance with Article L.221-18 of the French Consumer Code, you have a withdrawal period of 14 days from receipt of your products in which to exercise your right of withdrawal, without having to give reasons or pay any penalty, under the conditions set out in our returns and refunds policy.
To exercise your right of withdrawal, use the online withdrawal function provided for in Article L.221-21 of the French Consumer Code: you declare your decision and then confirm it, and a time-stamped acknowledgement is sent to you by e-mail. You may also send your request by e-mail to sav@maisonbagages.com or by post to the address given in the legal notice, quoting your order number.
Following your declaration, our customer service team sends you a prepaid return label by e-mail; the product is returned to us with this label, within 14 days of your declaration, in its original condition and complete (packaging, accessories, instructions). You are liable for any depreciation of the product resulting from handling other than what is necessary to establish its nature and proper functioning. A contribution to return costs of €8 is deducted from the refund, except where the return is due to a product defect or an error attributable to us. IML GROUP will refund the sums paid, including the initial delivery costs at the standard rate and less this contribution where applicable, using the same payment method as the one used for the order, no later than 14 days after receipt of the returned product.
Exceptions to the right of withdrawal. In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to:
Our products are offered for as long as they are visible on the website https://maisonbagages.com and while stocks last. If a product is unavailable after your order has been placed, we will inform you by e-mail. Your order will be automatically cancelled and no bank debit will be made. Furthermore, the website https://maisonbagages.com is not intended to sell its products in large quantities. Consequently, IML GROUP reserves the right to refuse orders for 3 identical items.
Orders are dispatched within 24 working hours: any order confirmed before 10 am is dispatched the same day. Delivery is free of charge in mainland France, with no minimum order; deliveries to other European countries are charged at the rate shown at the time of ordering. The carrier, indicative delivery times, charges and areas served are detailed in our shipping policy.
Products are delivered to the delivery address given during the ordering process, within the time frame shown on the order confirmation page. Should dispatch be delayed, you will be notified by e-mail of any impact on the delivery time you were given. In accordance with the law, in the event of late delivery you may cancel the order under the conditions and terms set out in Article L 138-2 of the French Consumer Code. If you receive the product in the meantime, we will refund it together with the shipping costs under the conditions of Article L 138-3 of the French Consumer Code. Where delivery is made by a carrier, IML GROUP cannot be held liable for a delivery delay due solely to the customer being unavailable after several proposed appointments.
All our products are covered by the legal guarantee of conformity, provided for by Articles L.217-3 et seq. of the French Consumer Code for two years from delivery of the product, and by the guarantee against hidden defects, provided for by Articles 1641 et seq. of the French Civil Code. If a product sold is not in conformity, it may be repaired, replaced or, failing that, taken back for a refund. All claims and requests for exchange or refund must be made by e-mail to sav@maisonbagages.com, quoting your order number. Products must be returned to us in the condition in which you received them, with all their components (accessories, packaging, instructions, etc.). Under these guarantees, return costs are borne by IML GROUP, which provides you with a return label. The provisions of this article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.
The products offered comply with current French legislation. IML GROUP cannot be held liable for any failure to comply with the legislation of the country to which the product is delivered. It is your responsibility to check with the local authorities whether the products or services you intend to order may be imported or used. Furthermore, IML GROUP cannot be held liable for damage resulting from misuse of the product purchased. Finally, IML GROUP cannot be held liable for any inconvenience or damage inherent in the use of the internet, in particular a service interruption, external intrusion or the presence of computer viruses.
The language of this contract is French. These terms and conditions of sale are governed by French law. In the event of a dispute, the French courts alone shall have jurisdiction.
All items on the website https://maisonbagages.com are and remain the exclusive intellectual property of IML GROUP. No one is authorised to reproduce, exploit, redistribute or use in any capacity whatsoever, even partially, any items on the website, whether software, visual or audio. Any simple or hypertext link is strictly prohibited without the express written consent of IML GROUP.
IML GROUP reserves the right to collect personal information and personal data concerning you. This is necessary to manage your order and to improve the services and information we send you.
